Can outsiders buy land in Himachal Pradesh?
Published · General information, not legal advice
Yes, but only with State Government permission under Section 118 of the HP Tenancy and Land Reforms Act, 1972. Anyone who is not an agriculturist of Himachal Pradesh — including many Himachalis — must apply for permission for a stated purpose, such as a house of up to 500 square metres.
Why Himachal restricts land sales
Section 118 was written to keep agricultural land with the people who farm it and to stop speculative buying in a small hill state. It applies to sale, gift, will, exchange, lease and mortgage with possession.
Who needs permission
The test is whether you are an agriculturist of Himachal Pradesh, not where you were born. A non-agriculturist Himachali also needs permission, while some categories, such as certain landless persons and government bodies, are covered by specific exceptions in the Act.
What you can get permission for
- A residential house — up to 500 square metres of land
- A shop or commercial establishment — a lower ceiling, commonly 300 square metres
- Industrial, tourism and other projects — case by case, often through the relevant department
Before you pay a token amount
- Check the jamabandi and tatima for the exact khasra numbers
- Confirm the land type and that the seller has a clear title
- Make the agreement conditional on Section 118 permission
- Have a local advocate review every document
